The terms and conditions that govern your access to and use of Meridian Daily, including content use, intellectual property, disclaimers and governing law.

These Terms of Service ("Terms") govern your access to and use of https://www.meridiandaily.com and any related pages, newsletters, feeds and services (together, the "Site"), operated by Meridian Daily Media, LLC ("Meridian Daily", "we", "us" or "our"), 1450 Harbor View Drive, Suite 210, San Diego, CA 92101, United States.

By accessing or using the Site, you agree to be bound by these Terms and by our Privacy Policy and Cookie Policy. If you do not agree, please do not use the Site.

1. Eligibility

The Site is intended for a general audience. You must be at least 13 years old to use the Site. If you are under the age of majority where you live, you may use the Site only with the involvement of a parent or legal guardian who agrees to these Terms.

We may revise these Terms from time to time. When we do, we will update the "Last updated" date on this page. Material changes will take effect when posted unless otherwise stated. All content on the Site, including articles, headlines, photographs, illustrations, graphics, videos, logos, the Meridian Daily name and design elements (the "Content"), is owned by Meridian Daily Media, LLC or its licensors and is protected by United States and international copyright, trademark and other intellectual property laws.

Permitted personal use

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and view the Content for your personal, non-commercial use. You may:

  • Read, view and print individual articles for your own personal reference.
  • Share links to our articles on social media, by email or on other websites.
  • Quote brief excerpts of our articles for commentary, criticism, news reporting or research, provided you clearly credit Meridian Daily and link to the original article.

Prohibited uses of content

Unless you have our prior written permission, you may not:

  • Reproduce, republish, distribute, sell, license or create derivative works from the Content, in whole or substantial part.

5. Communications You Send Us

When you send us messages, news tips, corrections, feedback, ideas or other materials (together, "Submissions"), you confirm that you have the right to share them and that they do not violate any law or third-party rights. Unless otherwise agreed in writing, you grant Meridian Daily a non-exclusive, royalty-free, worldwide license to use, review and, where appropriate and lawful, reference Submissions in connection with our reporting and operations. We are not obliged to use, respond to or keep any Submission confidential, although we will always treat sources and personal information responsibly and in accordance with our Editorial Policy and Privacy Policy. We do not accept unsolicited manuscripts or creative pitches on the understanding that they will be compensated.

6. Advertising and Third-Party Content

The Site displays advertising served by Google AdSense, Google Ad Manager and other partners. Advertisements are clearly labeled and are the responsibility of the advertisers. We do not endorse products or services advertised on the Site, and your dealings with advertisers are solely between you and them. Our articles, particularly in the Shopping section, may in the future include affiliate links. Where they do, we will disclose this clearly, and the presence of an affiliate link does not affect our editorial judgment.

We do not control and are not responsible for the content, privacy practices, availability or accuracy of third-party sites, and a link does not imply endorsement. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, SECURE OR FREE OF ERRORS, VIRUSES OR OTHER HARMFUL COMPONENTS.

11. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, MERIDIAN DAILY MEDIA, LLC AND ITS OWNERS, OFFICERS, EMPLOYEES, CONTRIBUTORS AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, DATA, GOODWILL OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATING TO YOUR USE OF, OR INABILITY TO USE, THE SITE OR CONTENT, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

BECAUSE THE SITE IS PROVIDED FREE OF CHARGE, OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS OR THE SITE WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS (USD 100). Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above limitations may not apply to you. You agree to indemnify and hold harmless Meridian Daily Media, LLC and its owners, officers, employees and agents from any claims, liabilities, damages, losses and expenses, including reasonable attorneys' fees, arising out of or related to your violation of these Terms, your misuse of the Site or your violation of any rights of a third party.

13. Privacy

Your use of the Site is also governed by our Privacy Policy, which explains how we and our partners, including Google, collect and use information, and by our Cookie Policy. You can update your cookie choices at any time using the Cookie Settings link in the footer.

We respect the intellectual property rights of others. If you believe that material on the Site infringes your copyright, please follow the notice procedure described in our Copyright Policy and send your notice to our designated agent at legal@meridiandaily.com.

15. Availability and Changes to the Site

We may modify, suspend or discontinue any part of the Site at any time, with or without notice. We may also remove or update Content at our discretion. We are not liable to you or any third party for any modification, suspension or discontinuation of the Site.

16. Governing Law and Disputes

These Terms and any dispute arising out of or relating to them or the Site are governed by the laws of the State of California, United States, without regard to its conflict of law principles. You agree that any legal action or proceeding shall be brought exclusively in the state or federal courts located in San Diego County, California, and you consent to the personal jurisdiction of those courts. Before filing any claim, you agree to first contact us at legal@meridiandaily.com and attempt to resolve the dispute informally for at least 30 days.

If you are a consumer residing in the European Union or the United Kingdom, nothing in this section deprives you of the protection of mandatory provisions of the law of your country of residence or of your right to bring proceedings in your local courts.

17. General

  • Entire agreement. These Terms, together with the policies referenced in them, form the entire agreement between you and Meridian Daily regarding the Site.
  • Severability. If any provision is found unenforceable, the remaining provisions remain in full force and effect.
  • No waiver. Our failure to enforce any right or provision is not a waiver of that right or provision.
  • Assignment. You may not assign these Terms without our consent. We may assign them in connection with a merger, acquisition or sale of assets.
  • Headings. Section headings are for convenience only and have no legal effect.
